NAGOMI プライバシーポリシー

株式会社Quixotiks（以下「当社」といいます。）は、当社の提供するサービス「NAGOMI」（以下「本サービス」といいます。）における、ユーザーについての個人情報を含む利用者情報の取扱いについて、以下のとおりプライバシーポリシー（以下「本ポリシー」といいます。）を定めます。

第１条 （適用範囲）

本ポリシーは、本サービスの利用に関して適用します。また、当社が本サービス上で公表するプライバシーポリシー、利用規約その他の個人情報保護方針においてユーザー情報の取扱いを定める場合には、そちらも適用されるものとします。ただし、当該規定と本ポリシーが抵触する場合には、本ポリシーが優先して適用されます。

第２条 （当社が取得する情報）

当社は、サービス提供および品質向上のため、以下のユーザー情報を取得します。

(1) 本サービスの利用にあたりユーザーにご提供いただく情報

メールアドレス、パスワード、本サービスのプロフィール欄に記入いただく情報、その他本サービスにおいて当社が指定する情報。

(2) 本サービスの利用にあたり当社が収集する情報

端末ＩＤ（デバイスＩＤ）、ＩＰアドレス、端末位置情報、サーバーアクセスログ情報、Ｃｏｏｋｉｅ、その他本サービスにおいてユーザーが送信する情報（音声、テキストデータ等。

第３条 （利用目的）

当社は、取得したユーザー情報を以下の目的で利用します。

1. 本サービスへの登録審査および本人確認
2. 本サービスの提供および運営管理
3. 利用料の請求・決済
4. お問い合わせ対応、各種ご案内の発信
5. 本サービスの規約・ポリシー変更、停止・中止、契約解除等の重要なお知らせ
6. 当社または第三者の商品・サービスに関する広告配信
7. 本サービスの維持・改善、新サービス開発
8. 利用状況の調査・分析

なお、利用目的を変更する場合は、変更前の目的と合理的に関連性がある範囲で行い、変更後は本サービス上または当社ウェブサイトでの掲示、電子メール等で通知します。

第４条 （第三者提供）

当社は、ユーザーの同意を得ない限り個人データを第三者に提供しません。ただし、以下の場合はこの限りではありません。

1. 本ポリシーに定める利用目的の達成に必要な範囲内において個人データの取扱いの全部又は一部を委託することに伴って当該個人データが提供される場合。
2. 合併その他の事由による事業の承継に伴って個人データが提供される場合。
3. 特定の者との間で共同して利用される個人データが当該特定の者に提供される場合であって、その旨並びに共同して利用される個人データの項目、共同して利用する者の範囲、利用する者の利用目的及び当該個人データの管理について責任を有する者の氏名又は名称について、あらかじめ、本人に通知し、又は本人が容易に知り得る状態に置いているとき。
4. ユーザーが本サービスの設定画面を通じて、当社による個人データの第三者提供に同意したとき。
5. 前各号に定めるもののほか、個人情報保護法その他の法令に基づく場合。

第５条 （個人情報の開示・訂正等の権利）

1.    ユーザーは、当社が保有する自己の個人データについて、利用目的の通知、開示、訂正・追加・削除、利用停止・消去（以下「開示等」）を請求できます。本人確認のうえ、法令に定める範囲内で速やかに対応します。

2.    開示等の請求は、第７条のお問い合わせ窓口までご連絡ください。

第６条 （本ポリシーの変更）

1. 当社は、ユーザー情報の取扱いに関する運用状況を継続的に見直し、必要に応じて本ポリシーを変更することがあります。
2. 変更後の本ポリシーは、本サービス上または当社ウェブサイトでの掲示、電子メール等の方法でお知らせします。ただし、法令上ユーザーの同意が必要となる変更を行う場合は、別途同意を取得します。

NAGOMI Privacy Policy

Quixotiks, Inc. (the “Company”) establishesthis privacy policy (this “Policy”) regarding the handling of user information,including personal information about users, in the service “NAGOMI” provided bythe Company (the “Service”), as follows.

Article 1 (Scope of Application)
This Policy applies to the use of the Service. In addition, where the Companysets out the handling of user information in privacy policies, terms of use, orother personal information protection policies published on the Service, suchprovisions shall also apply. However, if any such provisions conflict with thisPolicy, this Policy shall prevail.

Article 2 (Information the Company Obtains)
For the provision and improvement of the Service, the Company obtains thefollowing information (collectively, “User Information”).
(1) Information provided by users in connection with the use of the Service:
Email address, password, information entered in the profile section of theService, and other information designated by the Company on the Service.
(2) Information collected by the Company in connection with the use of theService:
Device ID, IP address, device location information, server access loginformation, cookies, and other information transmitted by users within theService (such as voice and text data).

Article 3 (Purposes of Use)
The Company uses the obtained User Information for the following purposes:
1. Screening of applications for registration to the Service and identityverification
2. Provision, operation, and management of the Service
3. Invoicing and payment of fees
4. Responding to inquiries and sending various notices
5. Important notices regarding changes to the Service’s terms and policies,suspension or discontinuation, termination of contracts, etc.
6. Delivery of advertisements regarding products and services of the Company orthird parties
7. Maintenance and improvement of the Service and development of new services
8. Surveying and analyzing usage status
If the purposes of use are changed, such changes will be made within a scopereasonably related to the purposes before the change, and notice of the changeswill be provided by posting on the Service or the Company’s website, by email,or by other means.

Article 4 (Provision to Third Parties)
The Company will not provide personal data to third parties without the user’sconsent, except in the following cases:
1. Where personal data is provided in connection with entrusting all or part ofthe handling of personal data within the scope necessary to achieve thepurposes of use set forth in this Policy.
2. Where personal data is provided in connection with the succession ofbusiness due to a merger or other reasons.
3. Where personal data is provided to specific parties for joint use with suchparties, and the fact of joint use, the items of personal data jointly used,the scope of joint users, the purposes of use by such users, and the name ortitle of the person responsible for the management of the relevant personaldata have been notified to the individual in advance or made readily accessibleto the individual.
4. Where the user has consented, through the Service’s settings, to theCompany’s provision of personal data to third parties.
5. In addition to the preceding items, where required under the Act on theProtection of Personal Information or other laws and regulations.

Article 5 (Rights to Disclosure,Correction, etc. of Personal Information)
Users may request notification of purposes of use, disclosure, correction,addition, deletion, suspension of use, or erasure (collectively, “Disclosure,etc.”) of their personal data held by the Company. Upon confirmation ofidentity, the Company will promptly respond within the scope prescribed byapplicable laws and regulations.
Requests for Disclosure, etc. should be directed to the contact point set forthin Article 7.

Article 6 (Changes to this Policy)

1. The Company will continuously review itsoperational practices regarding the handling of User Information and may changethis Policy as necessary.
2. The Company will notify users of the revised Policy by posting on theService or the Company’s website, by email, or by other appropriate means.However, where changes require user consent under applicable laws andregulations, the Company will obtain such consent separately.
